Abstract
What type of enforcement is the most promising to effectively punish violations of food law or to prevent them from occurring in the first place? This article examines the question of an optimal institutional design for the enforcement of food law. What mix of private and public enforcement does existing research from social science recommend? A review of this existing research is applied to the current regulation of enforcement in food law. Based on this, we content that the socio-economic and socio-cultural differences in the European multi-level system make it likely that EU-determined enforcement mechanisms are differently effective in the Member States. In Germany, for example, the enforcement system in C2B cases tends to privilege the defendant side in private enforcement.
