Abstract

This study presents an exploration of the socio-legal foundations and traditions that govern alternative child care in a society bound by plural legal orders. It traces the problem of children without parental care in Mainland Tanzania to depict its magnitude and causes. Recognising the alleged weakening of the customary-law-regulated traditional child care system, the study looks at the formal alternative child care solutions under state law. The research presented is centred on child adoption as the most long-standing statutory measure offering a permanent family-based solution to the problem. Further, considering the prevalent socio-cultural and economic situation in Tanzania that defines the leading type of adopters, the study is designed to concentrate on adoptions by non-resident Tanzanians and resident non-Tanzanians. These two types of adoptions are categorised in this study as child adoptions with an international element. The examination of the law and practice of child adoption generally, and of adoptions with an international element in particular, is guided by the question ‘What is in the best interests of the child?’. The best interests of the child principle serves as a yardstick against which the capacity of the legal, policy, and institutional framework to manage child adoptions is measured in the study. Together with this framework, an evaluation of the child adoption practice, specifically regarding adherence to the law and protection of children in adoption, is made. Recognising the central role that ‘street-level bureaucrats’ play in the adoption process, the study also considers the effects on the process of their workplace dilemmas and coping mechanisms. Lastly, based on statistics of registered adoptions, the potential of child adoption as a solution to the problem of children without parental care and protection in Tanzania is reflected on. To conclude the study, answers are given to the main research questions based on the research findings. Hoping for a better way forward, ways to improve child adoption law and practice in Tanzania are recommended.

Diese sowohl rechtsdogmatisch als auch rechtssoziologisch angelegte Studie beschäftigt sich mit rechtlichen Ausprägungen alternativer Sorge für Kinder in dem vom Rechtspluralismus geprägten Kontext Festland-Tansanias. Untersucht werden Gründe und Ausmaß der Probleme, denen Kinder ohne elterliche Sorge ausgesetzt sind. Vor dem Hintergrund der vielfach beobachteten Schwächung traditioneller Sorge für Kinder durch Verwandte im Rahmen des Gewohnheitsrechts prüft die Studie formale Lösungen alternativer Sorge für Kinder nach staatlichem Recht. Dabei liegt der Schwerpunkt auf der Adoption von Kindern als der ältesten im Gesetzesrecht vorgesehenen Maßnahme einer dauerhaften familienbasierten Problemlösung. Das besondere Interesse der Studie richtet sich auf Adoptionen zum einen durch tansanische Staatsangehörige, die im Ausland leben, und zum anderen durch ausländische Staatsangehörige, die in Tansania leben, denn diese beiden Gruppen machen die Mehrzahl der Adoptierenden aus. Diese beiden Adoptionskonstellationen werden hier als Adoptionen mit internationalem Element bezeichnet. Die Untersuchung von Recht und Praxis der Adoption im Allgemeinen und von Adoptionen mit internationalem Element im Besonderen folgt der Leitfrage nach dem besten Interesse des Kindes. Das Prinzip des besten Kindesinteresses dient als Maßstab, an dem der rechtliche, politische und institutionelle Rahmen daraufhin gemessen wird, ob er die Anforderungen an Kindesadoptionen erfüllt. Des Weiteren wird die Praxis der Kindesadoption ausgewertet, insbesondere im Hinblick auf die Erfüllung der rechtlichen Vorgaben und auf den Schutz von Adoptivkindern. Unter Verwendung des Ansatzes der ‘street-level bureaucrats’ wird untersucht, welche Rolle die praktischen Probleme, mit denen die sozialen Wohlfahrtsbehörden an ihren Arbeitsplätzen konfrontiert sind, und die von ihnen entwickelten Bewältigungsmechanismen im Verlauf des Adoptionsprozesses spielen. Auf der Grundlage von Statistiken registrierter Adoptionen wird schließlich diskutiert, welches Potenzial die Adoption als Lösungsinstrument für die Problematik eltern- und schutzloser Kinder in Tansania hat. Abschließend wird zu den aufgeworfenen Forschungsfragen Stellung bezogen und es werden Empfehlungen für eine Verbesserung von Recht und Praxis der Kindesadoption unterbreitet.
